Terms of Use

Welcome to Sumit Plaza

This document is an electronic record in terms of the Information Technology Act, 2000 and is published in accordance with the provisions of Rule 3 of the Information Technology (Intermediary Guidelines) Rules, 2011, which require publishing the rules and regulations, privacy policy, and Terms of Use for access or usage of the Sumit Plaza marketplace platform (hereinafter referred to as the “Platform”).

The Platform is owned and operated by Sumit PlazaPrivate Limited, having its registered and operational offices in India (details available on the Platform).

Your use of Sumit Plaza, its services, and tools is governed by the following Terms of Use, including applicable policies which are incorporated herein by reference. By accessing or using the Platform, you agree to be bound by these Terms of Use and all Sumit Plaza policies, including the Privacy Policy, as amended from time to time.

For the purpose of these Terms of Use:

“You” / “User” refers to any natural or legal person who accesses or uses the Platform, whether registered or not.
“Sumit Plaza ”, “We”, “Us”, “Our” refer toSumit Plaza Private Limited and its affiliates.

Sumit Plaza reserves the right to modify these Terms of Use at any time without prior notice. Your continued use of the Platform constitutes acceptance of the revised terms.

1. User Account, Password, and Security

If you create an account on the Platform, you are responsible for maintaining the confidentiality of your login credentials and for all activities carried out under your account.

You agree to:

Provide accurate, complete, and up-to-date information during registration
Immediately notify Sumit Plaza of any unauthorized use or security breach of your account
Log out from your account at the end of each session

Sumit Plaza reserves the right to suspend or terminate accounts that provide false, inaccurate, or incomplete information.

2. Services Offered

Sumit Plaza provides an online marketplace enabling users to browse and purchase jewellery and related products (“Products”) through various payment methods.

The purchase and sale of Products are additionally governed by specific policies including but not limited to Cancellation Policy, Return Policy, and Exchange Policy, which are available on the Platform and incorporated herein by reference.

At the time of initiating a return request, users must confirm that:

The product is unused
Original tags, certificates (if applicable), and packaging are intact

If a returned product is found to be used, damaged, altered, or missing original tags or certificates, the return request may be rejected and the product re-shipped to the customer. In such cases, the user shall not be eligible for a refund, and Sumit Plaza assumes no liability.

Product descriptions, images, pricing, and other content are provided for informational purposes only. Sumit Plaza does not warrant that such information is accurate, complete, or error-free.

3. Platform for Transactions and Communication

The Platform acts solely as a facilitator for transactions between buyers and sellers. Sumit Plaza is not a party to any transaction conducted on the Platform.

Accordingly:

All commercial terms such as price, delivery timelines, warranties, and after-sales services are agreed upon directly between buyers and sellers
Sumit Plaza does not guarantee the performance, quality, or availability of products
Sumit Plaza does not hold title, ownership, or interest in the products listed on the Platform

Sumit Plaza shall not be responsible for:

Non-performance or breach of contract between buyers and sellers
Delays caused due to stock unavailability, backorders, or logistics issues
Pricing errors arising from technical or typographical mistakes (orders may be cancelled in such cases)

You agree to indemnify and hold Sumit Plaza harmless from any claims, losses, or damages arising from user interactions or transactions on the Platform.

4. User Conduct and Platform Rules

You agree not to use the Platform to host, upload, publish, or transmit any content that:

Violates any applicable law or regulation
Is false, misleading, defamatory, obscene, abusive, or unlawful
Infringes intellectual property rights or privacy rights of others
Promotes illegal activities, fraud, or gambling
Contains malware, viruses, or harmful code
Attempts unauthorized access to the Platform or other user accounts

Users may be classified as fraudulent or abusive if they engage in activities including but not limited to:

Providing false contact or address details
Misusing offers, vouchers, or promotions
Refusing delivery or payment
Returning incorrect or used products
Placing bulk or resale-oriented orders
Any activity intended to cause financial loss to Sumit Plaza

Sumit Plaza reserves the right to cancel orders, suspend accounts, or restrict access if such behavior is detected.

5. Bulk Orders & Fair Usage

Sumit Plaza does not support business-to-business transactions. Orders intended for commercial resale, bulk purchasing, or misuse of platform policies may be cancelled at any stage.

Users intending to claim input tax credit are advised not to transact on the Platform.

6. Limitation of Liability

Sumit Plaza shall not be liable for any indirect, incidental, or consequential damages arising from the use of the Platform or products purchased through it.
